| REPORT ON PLANNING BOARD MEETING, JANUARY 16, 2007 VARIANCE RECOMMENDATIONS: The Planning Board voted for a Positive Recommendation to the ZBA. It was noted that the applicant does a good job of improving property. PUBLIC HEARINGS: No action was taken. Neighbors to the site stated their objections to an 80+ foot tower (mono-pole design) in the middle of a field. A 600-foot road would need to be built to access it. The landowner is in favor of the project. The Public Hearing remains open until further information is provided. Comment: It seems that there are five telecom companies that may make similar applications in the future. Regulation calls for towers to be built at least 500 feet from habitable structures but the regulation has no definition of “habitable structure”. 8:45 - 9:15 Planning Board member A. DePasqua The Planning Board gave preliminary and final approval. Comment: The landowner stated that he has no plans to develop further on the 2nd lot of 46.518 acres but would not agree to include that provision as a condition to approval. Apparently there is an apple orchard that is going to waste and the landowner would be interested in speaking to someone who would operate the orchard. 9:15 - 9:45 Planning Board member E. Werner It is unknown if there are any endangered species on this property. The applicant provided a (form) letter from NYSDEC stating that they are not aware of any. He plans to divide the property into 5.56 acres for lot 1 and the balance would be lot 2. Board member Werner wants to walk the site again due to concerns about wet conditions adjacent to the driveway. 9:45 - 10:15 Planning Board member E. Werner The owner still needs to obtain a variance from ZBA due to a pre-existing non-conforming structure. 27 acres to be divided into one 10-acre lot and the balance of 17 acres will be divided into lots 2 and 3.
